Divorce is a very difficult process to deal with for a number of reasons, not least the fact that your marriage has broken down. You not only have to deal with the emotional side of the breakdown, but the financial side needs to be considered too, especially if there are children involved as you will have to come to an agreement about who will look after them, and how to split financial responsibility too.

What is Maintenance?

Maintenance can be an amount that is paid to a parent who primarily cares for the children following the breakdown of the marriage. If you are caring for the children and are therefore unable to work full time, you may be financially worse off so child maintenance payments will go towards helping to balance that loss.

It can also be paid for your benefit even if you do not have children. You may not be able to work for health reasons or because you have been unable to find work. The amount paid in maintenance will vary depending upon the personal circumstances of both parties. If you are receiving maintenance from your ex-spouse and meet a new partner and move in together your maintenance payments may reduce as a result.

If you are paying maintenance and lose your job then you should consider reducing the maintenance that you pay.

How Emmersons Family and Child Maintenance Solicitors can help you ?

Based in both Newcastle and Sunderland, our solicitors specialising in child maintenance have been working with clients like you for years to help them to achieve the best outcome for themselves and their families.

We will offer you a meeting to discuss your situation and help you to understand your legal position. We will discuss with you in detail how much it will cost for us to act on your behalf and to ensure that you are happy for us to represent you.

We follow a collaborative approach to divorce which means that we try to work towards a fair settlement for both parties without animosity. You will receive independent legal advice but we can also work with your ex-partner’s solicitor face to face to try to work towards a good resolution.

There are many benefits to this approach; it can be quicker, less confrontational and also less expensive. If you are going through a separation and are considering a divorce or dissolution, please call us today.

WHAT OUR CLIENTS SAY...

"Your company were fabulous to work with and I will recommend it. I was dealt with by Tracy Hammond and her law student last week. Tracy was incredibly helpful, supportive, empathetic and professional in the high quality of the service and advice she provided me in relation to what are very upsetting family and matrimonial issues going on in my life right now. I found Tracy's advice invaluable she is clearly very experienced, knowledgable and yet fair, reasonable and operates with the true best genuine intentions of her clients, explaining thoroughly all available options in simple to understand terms. I would highly recommend Emmersons and Tracy especially without hesitation whatsoever. First-class professional and fair, equitable service here from top to bottom.”
Mrs W.
“I was delighted with the service I received. Your Lawyer was fantastic, and I could not recommend her enough. I had been with an alternative solicitor for many years and had never been advised that I did not need to go to court. She advised me to try mediation, which I did, and how the matter is resolved. I would definitely recommend.”

“Your Lawyer was so helpful and compassionate. She has been brilliant! I couldn’t fault her. She has been good to work with. Very straightforward and easy to talk to and she really understood my situation. Overall she has been great. As has Emmersons. I am very pleased with the service. Helaina was lovely, always calling me back and there have been no delays apart from those outside of her control. I would recommend this Family Lawyer and Emmersons to anyone.”
