At Emmersons Solicitors our Conveyancing Experts specialise in assisting clients to purchase the Freehold Interest of their Leasehold properties. Whether it be a recently built home or a long-standing property, your Landlord/Freeholder may offer you the opportunity to purchase the Freehold.
Your Landlord is entitled to charge you a premium for the privilege of having your Freehold. This process would only occur on properties where you only own the Leashold Interest (a Leasehold Property).
When you hold a Leasehold Property, the Freeholder will charge you an annual ground rent and a service charge, which can sometimes be very costly. In addition to this they can charge you additional fees if you wish to alter your property in any way.
For example, if you wish to build a conservatory they will charge you for granting their concent. Sometimes obtaining your Landlords Consent to alterations can cost hundreds of pounds.
It may, therefore, be better for you to purchase the Freehold of your property, which will remove the ground rent and services charges. It is at the descretion of the Freeholder/Landlord to sell the Freehold to you. However, under ceratin circumstancs they must sell the Freehold to you (if you have met certain Statutory Criteria). If you decide to purchase the Freehold then you will require a Specialist Conveyancing Solicitor to give you the correct legal advice before you sign the Transfer Deed.
Whether you are purchasing a Freehold with the assistance of a mortgage or with cash you should always seek the advice and assistance of a Specialist Solicitor with expert knowledge in this area.
