So, What is Probate?

Probate is an order of the court which grants you the authority to deal with the estate of the deceased. Here at Emmersons, we provide expert Wills and Probate Solicitors in Newcastle upon Tyne and Sunderland. There are two types of Grant of Representation:

A Grant of Probate – you can apply for this if you are an executor named in the will.

Letters of Administration – you can apply for this if the deceased did not leave a will and you are the next of kin.

It is important for you to understand that if you are applying for a Grant of Representation, then you become legally responsible for the administration of the estate.

What is your role as an Executor or Administrator?

  • You must take this role very seriously. Once you have established the value of the estate you must report this correctly to apply for Probate. You must give a declaration of truth as to the content of the forms that you complete.
  • You must pay all creditors of the estate before you give money or goods to anyone else. This includes returning overpaid state benefits and paying all tax due.
  • You must correctly identify and trace all beneficiaries of the estate and make sure they are paid their share, if there are sufficient monies left after paying all debts.
  • If there was no will then you must decide as a family who is to apply for Probate. Is it right that one or two of you assume the legal responsibility on behalf of all those to benefit?

By way of example, we were contacted by a client who had just flown in from America for his mother's funeral. Because of commitments back home, he was only in the UK for a very short period of time. He gathered all of the paperwork that he could and handed us the keys to his mother's home. Our client returned to America. We immediately arranged with a funeral director that they would be paid directly from the deceased's bank account thus meaning that her son did not have to worry about finding the money to pay for his mother's funeral.

We also arranged empty house insurance, brought in a cleaning team to clear out the house, clean the house and attend to the garden. We were able to deal with an Estate Agent who found a buyer. We also dealt with all finances including sorting out utility bills, pensions, savings and loans. We applied for Probate and thereafter distributed the proceeds of the estate to our client in America. He was extremely grateful as he did not have to attend to anything else once he had contacted us in the first instance. This was important to him as he was trying to come to terms with the sudden death of his mother.
