Civil Partnership Dissolution is the name given to the process which legally ends a Civil Partnership. The court process for dissolution or divorce of a Same Sex Civil Partnership or marriage is identical to traditional divorce proceedings. There is also now a court process for Same Sex Divorce, following the introduction of same sex marriage. It enables you and your partner to arrange your financial affairs and to have them sanctioned by the court if necessary.
Since the 6th April 2022 No Fault Divorce became legal in England and Wales. Therefore, you no longer have to blame your partner if you wish to end a marriage or Civil Partnership.
However, once proceedings are issued by your spouse or Civil Partner you cannot stop the process. Therefore it is essential you obtain legal advice as soon as possible in order to protect your financial position.
The first part of the Divorce is now known as the Conditional Order; this was previously called Decree Nisi. A Conditional Order can only be issued after a divorcing couple affirms their desire to continue with the Divorce.
There is a twenty week waiting period before a Conditional Order can be issued. This is to allow you to reflect as a couple and to give you time to reach agreement about your finances and your children. If the Divorce has come as a shock to you, you need to know that you cannot contest the Divorce (unless the English or Welsh court confirms that it does not have the jurisdiction to deal with your case or your marriage or Civil Partnership is not valid.) Therefore you will need to seek help from us very quickly as matters will proceed far faster than under the old law.
Six weeks after the Conditional Order you are able to obtain a Final Order (previously known as Decree Absolute) you are then Divorced.
