Couples going through separation can now obtain a divorce, dissolve a civil partnership, or secure a legal separation without assigning blame for the breakdown of their relationship.
No-fault Divorce is a new type of divorce law in the UK. This means that either party to the marriage can begin divorce proceedings without having to blame the other or without having to obtain the consent of their spouse or civil partner.
This also means that if you feel that your marriage is at an end you can issue proceedings without having to cite adultery or unreasonable behaviour on the part of your husband or wife.
If you find yourself in a violent marriage or your husband or wife is emotionally abusive or is coercively controlling you, then you can bring the marriage to an end quite quickly. However, if your husband or wife has simply fallen out of love with you or has met someone else, they can issue No-Fault Divorce proceedings against you without having to obtain your consent. In some cases, the first thing that you may know about the divorce is when your spouse has gone ahead and issued the proceedings. This may come as a huge shock!
A No-Fault Divorce can be issued online either by a sole applicant or by both parties by agreement. However, most of our clients ask us to issue the proceedings for them so that we can control the timetable and tie in the Financial Settlement with the divorce. Once the no-fault divorce proceedings are issued they cannot be defended even if you have done nothing wrong.The party or their solicitor issuing the proceedings simply needs to state that the marriage is irretrievably broken down.
You cannot defend a no-fault divorce unless you wish to claim that the marriage was unlawful in the first instance or filed in the wrong jurisdiction.

No. The person applying is called the applicant. There is no longer a decree nisi - this is now called a Conditional Order. The Decree Absolute is called a Final Order.
Once the court has issued proceedings, the applicant must wait 20 weeks before filing for the Conditional Order. Once the Conditional Order has been granted by the court, the applicant's solicitors must wait for a further 6 weeks before they can apply for a final order.
As you cannot stop the no-fault divorce proceedings, it is important that you seek legal advice from your solicitor. You may be left short of money, you may need help with maintenance for you or your children.
